Calorie-Wise

Terms and Conditions

Effective date: [EFFECTIVE DATE]

Please read section 4 (cancellation and refunds) and section 5 (lapse and data deletion) carefully. They explain when you can get a refund and what happens to your data if your subscription ends.

1. About these terms

1.1 These terms govern your use of Calorie-Wise, the website at calorie-wise.com and the Calorie-Wise mobile app (the "Service"), provided by Xentra Health, a division of Maynard Procurement Solutions Ltd, a company registered in England and Wales, number 08753201, registered office P O Box 8, Wilmslow, Cheshire, United Kingdom ("we", "us"). VAT number GB174 691576. Contact: info@xentrahealth.com.

1.2 By ticking the box at sign-up you accept these terms and confirm you have read our Privacy Policy.

1.3 You must be 18 or over and live in a country where we offer the Service. You must give accurate information and keep your login details secure. One account per person; accounts cannot be shared or transferred.

1.4 One free trial is available per person, per payment card and per device, including trials given by invitation. We may refuse a trial where we reasonably believe it has been claimed before. An invitation is personal to the person it was sent to and cannot be transferred.

2. Free trial and subscription

2.1 New users get a free trial with full access. The standard trial is 7 days. We may offer a longer trial (14 days, 1 month or 12 months) by invitation or promotion. The length that applies to you is shown before you start and again at checkout. We ask for a payment method at the start of the trial but take no payment during it.

2.2 We will remind you by email and in the app at least 2 days before the trial ends, telling you the date and amount of the first payment and how to cancel.

2.3 Unless you cancel before the trial ends, your annual subscription begins automatically at the end of the trial and the first annual payment is taken that day.

2.4 The subscription lasts 12 months from the first payment and gives full access to the Service for that period.

2.5 Free use. We may give some users free use of the Service, by invitation or promotion. Free use needs no payment method and nothing is charged. We may end free use by giving you at least 30 days' notice by email and in the app. You can then start a paid subscription to keep using the Service and your data; if you don't, section 5 applies from the end of the notice period. You can delete your account at any time.

3. Prices, payment and auto-renewal

3.1 The annual subscription costs:

CurrencyPrice per year
Pounds sterling£30
Euros€35
US dollarsUS$40
Australian dollarsA$60

Prices include VAT, or local sales tax where it applies. You pay in the currency shown at checkout for your country.

3.2 Where you pay. Subscriptions are bought on our website, and payment is taken by Stripe. The app uses the same account: sign in with the email and password you used on the website. If we later offer subscriptions inside the app, payment there will be taken by Apple or Google under their terms, and their refund processes will apply to those payments (see 4.6).

3.3 Auto-renewal is your choice. When you start your subscription, and at any time in your account, you choose whether it renews automatically.

3.4 If auto-renewal is on, we remind you by email and in the app 30 days and 7 days before each renewal, stating the date, the amount and how to switch auto-renewal off.

3.5 We may change the price of future renewals. We will tell you at least 30 days before the renewal it applies to, and you can switch auto-renewal off before then. A price change never affects a year already paid for.

4. Cancellation, cooling-off and refunds

4.1 During the free trial you can cancel at any time in your account and pay nothing.

4.2 Cooling-off period. By law you can cancel within 14 days of signing up (the date your trial starts). Because the Service starts immediately, when you start your subscription we ask you to confirm that you want it to begin during the cooling-off period. If you then cancel after the first payment but within those 14 days, we refund the payment less a proportionate amount for the paid days you have used.

4.3 After the cooling-off period, no refunds. The trial lets you test the Service before paying. Once the cooling-off period has ended, payments are non-refundable and no refund is given for unused months, whether or not you have used the Service. If you cancel, you keep access until the end of the paid year and the subscription does not renew.

4.4 Renewals. If you cancel within 14 days after an automatic renewal, we refund the renewal payment less a proportionate amount for the days since renewal. After those 14 days, renewal payments are non-refundable.

4.5 Your statutory rights are not affected. If the Service is faulty or not as described, you may be entitled to a repair, a price reduction or a refund under the Consumer Rights Act 2015 or the equivalent law of your country.

4.6 App store purchases. If you subscribed through Apple or Google, cancellation and refunds are handled through your App Store or Google Play account under their policies. You can still use section 4.5 with us.

4.7 How to cancel: sign in at calorie-wise.com, go to Your account and choose Manage subscription or cancel, or email info@xentrahealth.com. Cancelling is never harder than signing up.

5. Failed payments, lapse and data deletion

5.1 Failed or expired card. If a payment fails, for example because your card has expired or changed, we email you straight away and show a notice in the app and in your account asking you to update your payment details.

5.2 14-day grace period. Your account stays fully usable for 14 days after a failed payment, or after a subscription or trial ends without renewal. During that period we send a reminder every day by email and in the app, stating how many days remain and that your data will be deleted if you do not renew.

5.3 Lapse. If you have not paid or renewed by the end of the grace period, your subscription lapses and your access ends.

5.4 Deletion. After lapse your food logs, health data and other account content are permanently deleted within 30 days and cannot be recovered, as set out in our Privacy Policy. We warn you 7 days before deletion. You can download a full copy of your data at any time before then using "Download my data" in your account.

5.5 You can stop the daily reminders by renewing, cancelling, or deleting your account.

6. Health information and acceptable use

6.1 Not medical advice. Calorie-Wise provides general information to help you track what you eat and drink. It is not a medical device and does not diagnose, treat or prevent any condition. Calorie, nutrient and alcohol figures, including those estimated from photos, labels or descriptions using artificial intelligence, are estimates and may be inaccurate. Check them and correct them where you can.

6.2 Speak to a doctor or registered dietitian before changing your diet if you are pregnant or breastfeeding, have a medical condition, take medication, or have had an eating disorder. If you are worried about your eating, contact your GP or the eating disorder charity Beat.

6.3 Medication and supplements. If you choose to record medication (such as GLP-1 medicines) or supplements (such as GhrelinX), Calorie-Wise only records what you enter. It does not recommend doses, missed-dose action, or starting, stopping or combining any product. Supplements are not equivalent to, or a substitute for, prescribed medicines. Always follow your prescriber's advice and the product label.

6.4 You must not: misuse, copy, scrape or reverse-engineer the Service; access another person's account; upload unlawful or harmful content; or use the Service for any commercial purpose without our written agreement.

6.5 We may suspend or close an account that seriously or repeatedly breaks these terms. Unless the breach is serious, we will warn you first. If we close your account without fault on your part, we refund the unused part of your subscription.

6.6 All rights in the Service, its software, design and content belong to us or our licensors. You keep ownership of the data you enter, and give us a licence to use it only as needed to provide the Service and as set out in our Privacy Policy.

7. Anonymous research data (optional)

7.1 When you sign up, and at any time in your account, you can choose whether to share anonymous research data with us by ticking a box. It is unticked unless you tick it. Your choice makes no difference to the price or to how the Service works for you.

7.2 If you tick it, you agree that we may collect, from the app, weekly summaries of your records: your age band, sex, country, body mass index band, percentage weight change since you started, how long you have tracked, whether you record a GLP-1 medicine and which one and what dose, whether you record GhrelinX and how often you confirm taking it, your average calories, protein, water, exercise and alcohol, your hunger and craving scores, and which symptoms you record. These summaries do not include your name, email address, exact age, date of birth, height, exact weight, photos, food descriptions or location, and they are stored under a random code instead of your account.

7.3 We use this data to measure the progress people make, in particular people using GLP-1 medicines and GhrelinX, to improve the Service and to produce research and reports. We only ever report figures for groups of at least 5 people, and we will never publish or share anything that identifies you. Our Privacy Policy, section 4, explains how this data is protected.

7.4 If you leave the box unticked, none of your data is collected for research. If you untick it later, we stop collecting and delete the research data you have already given. Figures we have already published, which cannot identify anyone, cannot be withdrawn.

7.5 Research figures come from what users record themselves and are not a clinical trial. They do not show that any medicine or supplement will work for you.

8. Liability, changes, law and disputes

8.1 We provide the Service with reasonable care and skill. We aim for it to be available at all times but cannot guarantee it will be uninterrupted or error-free.

8.2 We are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our negligence. We are not responsible for loss that was not foreseeable, or for business losses.

8.3 Except as set out in 8.4, our total liability to you in any 12-month period is limited to the amount you paid us in that period.

8.4 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law, including your statutory consumer rights.

8.5 Changes to these terms. We will give you at least 30 days' notice of significant changes by email and in the app. If you do not agree, you may cancel before the change takes effect and we refund the unused part of your subscription.

8.6 Law and courts. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may bring proceedings in your local courts. If you live elsewhere, you keep the protection of the mandatory consumer laws of your country.

8.7 Complaints. Contact info@xentrahealth.com first. We aim to resolve complaints within 14 days.

8.8 If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a right straight away does not waive it.
